Hỏi: Chị A là giảng viên má»™t trường đại học. Chị vừa hoàn thành khóa học cao học và Ä‘ang tham gia nghiên cứu má»™t đề tài khoa học cấp nhà nÆ°á»›c. Mặc dù bận rá»™n chị vẫn thu xếp việc nhà chu đáo nhÆ°ng anh C chồng chị cÆ°Æ¡ng quyết phản đối việc tham gia nghiên cứu khoa học của chị vì sợ chị sẽ có trình Ä‘á»™ cao hÆ¡n mình. Anh dọa sẽ đập phá đồ đạc trong nhà nếu chị A không từ bỏ việc này. Hành vi trên của anh C có vi phạm pháp luật về bình đẳng giá»›i không? Vì sao?

 Văn phoÌ€ng Luật sÆ° Tô ĐiÌ€nh Huy xin trả lÆ¡Ì€i: 

 Việc cản trở vợ mình tham gia nghiên cứu khoa học của anh C là vi phạm pháp luật về bình đẳng giá»›i. Theo quy định tại khoản 5, Điều 40 của Luật bình đẳng giá»›i, các hành vi vi phạm pháp luật về bình đẳng giá»›i trong lÄ©nh vá»±c khoa học và công nghệ gồm:

          a. Cản trở nam, nữ tham gia hoạt Ä‘á»™ng khoa học, công nghệ;

          b. Từ chối việc tham gia của má»™t giá»›i trong các khóa đào tạo về khoa học và công nghệ.

Trong trường hợp này anh C đã không khuyến khích vợ, lại có thái độ không đúng khi vợ tham gia nghiên cứu khoa học để phục vụ cho công việc của mình mặc dù chị A vợ anh vẫn thu xếp việc nhà chu đáo. Hành vi của anh C đã vi phạm pháp luật, có thể bị xử lý kỷ luật, xử phạt hành chính hoặc truy cứu trách nhiệm hình sự.
